Terms of Service
Effective date: September 29, 2026
These terms cover the Zybler front desk: replies, the lead log, missed-call voicemail, and the texting program when it is on.
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Eight Zero Seven LLC dba Zybler ("Zybler," "we," "us," or "our"). They cover your use of Zybler and zybler.com. By signing up for or using Zybler, you agree to these Terms. If you are signing up for a business, you confirm that you are allowed to agree to these Terms for that business, and "you" means the business.
Our Privacy Policy and SMS Terms also apply. If those pages conflict with these Terms on a privacy or texting point, the Privacy Policy or SMS Terms control for that point.
2. What Zybler does
Zybler is an always-on front desk for small businesses. Zybler:
- Instantly replies to leads that come in by email and website form.
- Logs each lead and alerts you.
- On the Premium plan, answers missed calls that you forward to a Zybler number with a greeting in your business's name, records and transcribes the voicemail, and emails it to you. When missed-call text-back is on, Zybler later sends the caller a follow-up text about that call.
Replies and transcripts are generated using AI. They may sometimes be incomplete or wrong, so you should check the original messages and recordings for anything important.
Features marked "Coming soon" on zybler.com, including missed-call text-back, text alerts, a booking link, a live AI receptionist, and booking onto your calendar, are not part of the service until we say they are available. Ultimate is not available yet.
Zybler does not promise that every lead will become a job. It does not replace your license, your insurance, or your own follow-up.
3. Plans and billing
- Plans. Zybler offers paid monthly plans. All plans come with a free 15-day trial for new customers. Current plan features and prices are shown on zybler.com or at checkout.
- Billing. Plans are billed monthly through Stripe. The billing period starts on the signup date, not on the 1st of the month. By choosing a plan, you authorize us, through Stripe, to charge your payment method each month until you cancel.
- Setup fee. Some plans may include a one-time setup fee. Any setup fee will be shown at checkout before you pay. The one-time setup fee is non-refundable. The Premium card on the site says: "One-time setup fee may apply; shown at checkout."
- Price changes. We may change prices. We will give you 30 days' notice before a change affects your plan.
- Failed payments. If a payment fails or is not received, the account goes inactive after a 15-day grace period.
- Taxes. Prices include any applicable tax.
- Starter limits. Starter is limited to the lead volume shown on the site. If you go past that limit, new leads may not be handled until the next month or until you move to a higher plan.
4. Cancellation
- You can cancel at any time through our website.
- When you cancel, the account deactivates at the end of the current billing period. It is not renewed for another period.
- Refunds. There are no refunds. Fees already paid are not refunded. The one-time setup fee is non-refundable.
- If you cancel call service, you are responsible for turning off call forwarding to the Zybler number.
- We may suspend or end your account if you break these Terms, if your use creates legal or security risk, or if we stop offering the service.
5. Acceptable use
You agree to use Zybler only for lawful purposes. In particular:
- No spam. You may not use Zybler to send unsolicited, bulk, or marketing messages, by email or by text.
- Your own leads only. You may use Zybler only for leads and callers who contacted your business. You may not upload, import, or message contact lists, or use Zybler to reach people who have not contacted you.
- You may not use Zybler to send anything illegal, harassing, deceptive, or harmful, or to impersonate anyone other than your own business in the greeting and replies we send for you.
- You may not try to break, overload, reverse-engineer, or get unauthorized access to Zybler or its providers' systems.
- You must follow the rules of our service providers and mobile carriers that apply to the messages and calls sent through Zybler.
We may suspend service or remove content if we believe these rules are being broken.
6. Your responsibilities
- Call forwarding. You are responsible for setting up, testing, maintaining, and turning off call forwarding from your phone line to your Zybler number, including any charges from your phone company. If forwarding is not set up or stops working, Zybler will not receive your missed calls.
- Accurate business information. You are responsible for making sure the business information you give us (such as your business name, services, hours, service area, and contact details) is accurate and up to date. Zybler uses this information in replies, greetings, and texts.
- Your contact details. You are responsible for keeping the email address and phone number where we send lead alerts and voicemails current, and for checking them.
- Account security. You are responsible for activity on your account and for keeping your login information safe.
- Following the law. You are responsible for your own business's compliance with laws that apply to you, including how you follow up with leads and callers. The sections below describe some of those responsibilities.
7. Call recording and your role
Florida law, Fla. Stat. § 934.03, generally requires all parties to consent before a wire, oral, or electronic communication is recorded. Zybler's greeting is how we tell the caller. The greeting thanks the caller for calling your business by name, then says:
We may text you at this number about your call. Msg and data rates may apply. Reply STOP to opt out. This call may be recorded. Please leave a message after the tone.
It includes "We may text you at this number about your call." and "This call may be recorded."
You agree that:
- you will not forward calls to Zybler in a way that skips or talks over that greeting;
- you will not record the same call yourself unless you have the consent Florida law requires;
- you will use recordings and transcripts only for the job the caller asked about, and for your own records; and
- you will not publish a recording or transcript without a lawful basis.
8. Texting, the TCPA, and the Florida Telephone Solicitation Act
Missed-call text-back is part of the SMS Terms when it is turned on. The Telephone Consumer Protection Act, 47 U.S.C. § 227, and the Florida Telephone Solicitation Act, Fla. Stat. § 501.059, restrict certain automated calls and texts, especially sales messages.
You agree that:
- Zybler may text a caller only about the inbound call they placed, and only after they heard the greeting notice;
- you will not use Zybler to text purchased lists, old customers who did not just call, or marketing offers;
- when the product asks, you will confirm in the SMS consent checkbox on the Premium plan that texting is used only to follow up on inbound calls; and
- your own later calls and texts, outside Zybler, are your responsibility, including any consent those messages need.
Agreeing to receive Zybler's texts is not a condition of anyone buying goods or services.
9. Email and CAN-SPAM
The CAN-SPAM Act, 15 U.S.C. §§ 7701–7713, sets rules for commercial email, including identification, a physical address, and an opt-out for marketing mail. A reply to a person who just emailed you or submitted your form is usually a relationship or transactional message, not an advertisement.
You will not use Zybler to send advertisements, newsletters, or bulk promotions. You will give us a business name and contact path that are real.
10. Your data
You keep ownership of your business information and your lead data. You give us permission to use it to provide and improve Zybler, as described in our Privacy Policy.
You confirm that you have the right to give us that information, including messages from your customers.
11. Service providers
Zybler relies on third-party providers, including Twilio (calls and text messages), Mailgun (email), xAI (AI replies and transcription), Heroku (hosting for the Zybler app and backend), Vercel (hosting for zybler.com), and Stripe (payments). Their outages or changes can affect Zybler, and we are not responsible for their services.
Phone carriers can delay or drop a call or a text. Carriers are not liable for delayed or undelivered messages. That line is also in the SMS Terms.
12. No guarantees
Zybler is provided "as is" and "as available." We work to keep Zybler running reliably, but we do not promise that it will be uninterrupted, error-free, or that every lead, call, message, alert, reply, recording, or transcript will be received, delivered, or accurate. We do not promise any particular business results, such as more jobs or revenue. To the extent the law allows, we disclaim all other warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some warranties cannot be disclaimed. If you are a consumer protected by Florida law, this section does not take away rights that the law says we cannot take away. See the Florida Deceptive and Unfair Trade Practices Act section below.
13. Limitation of liability
To the fullest extent the law allows:
- Missed or delayed leads. Zybler is not liable for any lead, call, voicemail, message, or alert that is missed, delayed, not delivered, or handled incorrectly, or for any business, jobs, revenue, or profit you lose as a result, whatever the cause (including problems with call forwarding, phone carriers, email, internet service, AI output, or our service providers).
- Zybler is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
- Zybler's total liability for any claim relating to these Terms or the service is limited to the fees you paid us in the 3 months before the claim. For a free trial account, the cap is $100.
This cap does not apply to a liability that Florida law does not allow us to limit, including a liability that cannot be waived under the Florida Deceptive and Unfair Trade Practices Act.
14. Indemnity
You agree to indemnify Eight Zero Seven LLC dba Zybler and its agents against claims, damages, and reasonable legal costs arising from your misuse of Zybler, from your content (including your business information, greetings, lead messages, and other material you provide), and from your own failure to comply with laws that apply to your calls, your call recording, and your texts.
That duty covers claims that a greeting, reply, recording, or text sent through Zybler because of what you set up or what you asked us to send broke a calling, recording, or texting law. It is your indemnity to us for that conduct and that content.
15. Florida Deceptive and Unfair Trade Practices Act
The Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. §§ 501.201–501.213, prohibits unfair or deceptive acts or practices in trade or commerce. A person who is harmed by a violation may have remedies under that statute, including declaratory relief, an injunction, and actual damages, and in some cases attorney's fees.
We will not describe a feature as available when the site says it is coming soon. We will not invent testimonials, customer counts, or savings. You will not ask Zybler to send a message that you know is false, including a greeting that uses a business name that is not yours.
Nothing in these Terms is a waiver of a right the statute does not allow either party to waive. If a court finds that a disclaimer or cap cannot be enforced against a particular claim, the rest of these Terms still apply.
16. Florida law and Brevard County venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
You and Zybler agree that any dispute will be brought in the state or federal courts for Brevard County, Florida. You and Zybler accept those courts' jurisdiction and venue.
There is no arbitration clause. There is no class-action waiver tied to arbitration. These Terms do not send a dispute to a private arbitrator, and they do not give up the right to be part of a class action as the price of an arbitration agreement.
17. Changes to these Terms
We may update these Terms. We will post the updated version on this page and update the effective date. If you keep using Zybler after changes take effect, you accept the updated Terms.
If you do not agree to a material change, stop using Zybler and cancel as described above before the change applies to you.
18. Other terms
- If any part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part of these Terms right away, we can still enforce it later.
- You may not transfer your account or these Terms without our written permission. We may assign these Terms as part of a merger, financing, or sale of the business.
- These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and Zybler about the service.
- Section headings are for reading. They do not change the meaning.
- These Terms do not create a partnership, joint venture, or employment relationship.
